Ancillary services (§§ 5–8)

§ 5: TSOs must, after consulting DSOs and other market participants, develop specifications for non-frequency ancillary services and standardized market products, and submit them to Ei for approval.

§ 6: Ei shall approve these if they ensure genuine, non-discriminatory participation by relevant market participants.

§ 7: DSO guidelines for procuring products and services needed for the distribution grid must be objective, non-discriminatory and transparent. DSOs must consult TSOs and other relevant participants when developing these guidelines.

Flexibility in distribution networks (§§ 10–12)

§ 10: A distribution network company shall:

  1. After consulting TSOs and other relevant market participants, develop specifications for the flexibility services it procures and standardized market products for such services
  2. Submit specifications and products to Ei for approval
  3. After Ei approval, publish a list of the market products

§ 11: Ei shall approve specifications and products if they ensure genuine, non-discriminatory participation by relevant market participants.

§ 12: Ei may issue regulations on how the list of market products shall be published.

These three sections implement ellagen 3 kap. 15 § and form the statutory basis for Ei’s approval authority over DSO flexibility market products. The product approval requirement here is distinct from the method pre-approval requirement in ellagen 4 kap. 46 § (which applies to individual contract terms).

First exercise of §10 authority: In December 2025, Ei approved the LFM-h/p/e standardized product set submitted by Energiföretagen Sverige — case 2025-102414, seven nätföretag approved. This was the first time Ei exercised the §10–12 approval pathway. DNDP requirements (§§ 13–15)

§ 13: A DNDP developed under ellagen 3 kap. 16 § shall:

  1. “redogöra för behovet av flexibilitetstjänster på medellång och lång sikt” (describe the need for flexibility services at medium and long term)
  2. State planned investments for the coming 5–10 years, with emphasis on main distribution infrastructure required to connect new production capacity and new loads
  3. Describe the resources to be used as alternatives to grid expansion

These are the three substantive content requirements at government ordinance level, which EIFS 2024:1 then specifies in full procedural detail.

§ 14: The company shall consult the TSO and relevant system users when developing a DNDP. The consultation result must be published alongside the plan and submitted to Ei.

§ 14a (added by Förordning 2025:272): “Energimarknadsinspektionen ska sammanställa innehållet i nätutvecklingsplanerna och göra det tillgängligt på sin webbplats.”Ei has a statutory obligation to compile DNDP content and make it available on its website. This is the legal basis for Ei’s DNDP map tool/web portal and for the aggregate data published in Ei PM2025:03. This provision was added specifically to mandate the publication function that had been established in practice.

§ 15: Ei may issue further regulations on:

  1. (a) what a DNDP must contain and how it must be developed, and (b) publication requirements
  2. How the DNDP shall be submitted to Ei

This is the direct delegation basis for EIFS 2024:1.

Energy storage dispensation (§§ 18–22)

§ 18: Ei may grant case-by-case dispensation from the storage ownership ban (ellagen 3 kap. 39 §) if the installation is a “helt integrerad nätkomponent” or if: (1) third parties couldn’t provide comparable service after a non-discriminatory tender that Ei has reviewed and approved; (2) the installation is needed to fulfill grid obligations; (3) it is not used to trade on electricity markets; and (4) Ei has assessed the need and reviewed the tender.

§§ 19–21: If dispensation is granted, Ei must conduct a public consultation on existing storage installations at least every 5 years (at least 2 years after granting dispensation). If the consultation shows third parties can own/operate storage cost-effectively, Ei must decide the dispensation expires 18 months after the consultation. Grandfathering for installations with final investment decision before 4 July 2019 (DSOs) or 1 January 2025 (TSOs).

Information for demand flexibility (§§ 26a–26c, added by SFS 2025:1319)

§ 26a: TSOs must make available: (1) the share of electricity delivered that is renewable per bidding area, and (2) greenhouse gas emissions from electricity production. Must include forecasts.

§ 26b: DSOs must make this TSO information available and also publish anonymized/aggregated data on installations with potential for demand flexibility within their own grid.

§ 26c: This data must be available digitally in a standardized format readable by smart metering systems, EV charging points, heat/cooling systems, and building energy management systems.
