The Balance Responsible Party (BRP) agreement governing all parties that hold balance responsibility in the Swedish electricity system. Companion contract to the BSP agreement (Source - Svk BSP Avtal 5937-2 (2025)). Four documents: main agreement, definitions annex, general conditions annex, and a proposed amendment document for version 5938-3.

Main agreement — key contractual provisions

  • BRP obligation: maintain balance per 15-minute quarter, per bidding area — planning, commercial, and economic responsibility for all imbalances between measured supply and measured demand in every Leveranskvart (Section 4, Bilaga 1)
  • Settlement: eSett Oy handles all settlement, invoicing, and payment on Svk’s behalf (Section 5)
  • Fees: three fee types — Grundavgift (on volume), Obalansavgift (on imbalance volume), fast Veckoavgift; levels set by Svk with 2-month notice (Section 7, Bilaga 2 Section 4.3)
  • Securities: BRP must post collateral via eSett Oy (Section 8)
  • Material breach: SEK 100,000 fine (vite); examples: payment delays >2 banking days, missing eSett Oy settlement agreement, systematic large imbalances (Section 9)
  • Amendment notice: Svk may unilaterally amend with 2 months’ notice, after consultation in Elmarknadsrådet (Section 14)
  • Termination: BRP gives 1 month notice; Svk gives 3 months notice. If Svk makes an amendment, BRP has the right to terminate effective on the amendment date with 1 month’s notice (Section 15)
  • REMIT compliance: balance responsibility register is public; third parties may access it (Section 6)

BRP general conditions (Bilaga 2)

Frequency behaviour constraint

BRP must not on its own initiative make production changes that worsen the frequency deviation when frequency is outside 49.92–50.08 Hz. Applies to all production starts/stops that a BRP controls for its own account.

Quarter-boundary production shifts

If a BRP’s total production change after intraday market close exceeds 200 MW between two consecutive quarters:

  • The change must be spread as evenly as possible from 5 minutes before to 5 minutes after the quarter boundary
  • Energy volumes before and after the boundary must be as equal as possible
  • A Produktionsförflyttningsreglerobjekt (transfer control object) is created per bidding area as needed

This prevents large step-changes in scheduled production from creating sudden imbalances around quarter boundaries.

Eight production types for structuring: vattenkraft (hydro), kärnkraft (nuclear), vindkraft (wind), solkraft (solar), vågkraft (wave), reservkraft (gas turbine + diesel), värmekraft övrig (other thermal), ospecificerad.

The Strategic Reserve surcharge structure — applying only to SE3 and SE4 (the consumption-heavy southern zones), only on weekdays, only in the peak winter period — reflects the geographic and seasonal concentration of balancing risk in Sweden.

Proposed changes — version 5938-3 (consultation document, 2026-04-07)

Consultation closes 8 May 2026; planned effective date 2026-09-01. No re-signing required from existing BRP parties.

Change 1: New mandatory legislation clause (Section 14)

New contract text allowing Svk to directly implement contract amendments required by legislation, conditional on NRA (Ei) approval of the method used to design the amended terms. This is a significant governance change — it creates a fast-track for EU Network Code and other regulatory mandates to flow directly into the BRP agreement without the standard 2-month bilateral amendment process, subject to NRA oversight.

Change 2: Reglerobjekt registration lead time (Bilaga 2, Section 2.1)

Registration deadline for a new Reglerobjekt shortened from 14 days to 3 days before start date.

Motivation: A supplier switch (which in practice means a BRP change) can be cancelled by the customer up to 4 days before start — so it’s only confirmed 3 days before. The 14-day deadline was therefore impractically early. The 3-day timeline aligns BRP registration with the confirmed supplier-switch window.

Also clarified: individual production/consumption facilities (not whole Reglerobjekt structures) are what transfer between BRPs during a takeover.

Change 3: Strategic Reserve financing references updated (Bilaga 2, Section 4.4)

Updated to reference Lag 2025:50 and Förordning 2025:835 explicitly — the new capacity mechanism legislation enacted in 2025. Replaces older references.
